1. Introduction

  • 1.1 Below are our terms and conditions. These terms will apply to anyone who views or uses the Site.
  • 1.2 Please read these terms and conditions carefully before you use our Site and online service to book a parking space or advertise your parking space.

2. Roles and legal relationships

2.1 Using the Site

These terms and conditions will apply to anyone who views or uses the Site.

2.2 Privacy Policy

Our Privacy Policy, which is set out here https://place2park.co.uk/privacy-policy applies to you if you visit our Site.

2.3 Our Online Service

Our Online Service is a parking space rental agency which allows individuals and businesses that have available parking spaces to advertise the parking spaces, and to enter into agreements with individuals to pay use the parking spaces.

2.4 Parking Contract

If you wish to book a parking space through our online service, you will be bound by our Parking Contract between you and the space provider or Space Owner.

2.5 Advertising your parking space

If you use our online service to advertise your parking space for rental, you will be bound by the terms set out here.

3. Our online service

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy and is provided on an "as is" basis. To the extent permitted by law, we hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by any law, regulation, statute, common law or law of equity.

3.1 Parking spaces

Whilst we try to ensure all parking spaces listed with us are of a high standard, we offer no guarantee as to any parking space's suitability as we entrust the Space Owner or Space Provider for the details on their space or space’s, and whilst we use reasonable efforts to verify the accuracy of the information it is provided on an "as is" basis, and we offer no warranty in relation to these details.

3.2 Availability of the parking spaces

We will reserve any parking space booked through our Site based on the information provided to us by the Space Owner or Space Provider, however, we do not warrant the availability of any parking space because all information on is provided to us by the Space Owner or Space Provider.

3.3 Availability of our online service

We will use reasonable endeavours to make sure our online services are available through the Site, but do not warrant that access to the online services or Site will be uninterrupted or error-free.

4. Registration

Registration with the Site to use our online service is currently free, however in order to become a registered user you will have to provide some basic information:

4.1 Registering as a Space Owner

To register as a Space Owner and use our online service to advertise a parking space you will need to provide the following information:

  • Name
  • mobile number;
  • valid email address;
  • address for each relevant parking space;
  • parking space listing details

4.2 Registering as a Driver

If you want to use our online service to book a parking space will need to register as a Driver and provide the following information while registering:

  • Name
  • mobile number;
  • A valid email address; and
  • Vehicle registration number any vehicle or vehicles that you want to be able to park

We may also require additional information from time to time.

4.3 Use of the account

You agree that you will not:

1. Use the Online Service or deal with other users of the Online Service in any way which could be deemed to be harmful to our business or reputation, or do anything which might adversely affect our relationship with a Space Owner or a Driver.

2. Solicit or perform services for, or induce or attempt to induce, any customer, supplier, licensee or business relation of us, or any Driver or Space Owner, through any communication including written and oral communication made by yourself or a third party to enter into any arrangement relating to parking other than through us.

4.4 Inaccurate contact details

If you do not provide accurate contact information, you may not receive a booking/listing confirmation or other important information from us about your booking/listing or your account. We are not responsible if you fail to receive communications in these circumstances, and if you become aware that you have supplied inaccurate contact information, please get in touch with us immediately to correct the information we hold about you.

4.5 Suspension or closure of account

We may suspend or close your account at any time if you are in breach of any of these terms or any of the terms included in the Parking Contact either as a Driver or a Space Owner.

4.6 Password and security

When registering on our Site for our online service you will need to create a password. You are required to ensure that the password is kept confidential and is not disclosed to any third party. If you reveal your password to a third party and they then access the Site they will be deemed to be acting as an agent for you. We will not be held responsible for any action taken by any third party to whom you have disclosed your password. If you believe a third party has become aware of your password and is using your account without authorisation from you, please get in touch with us to let us know.

5. Intellectual Property

1. The information provided on Site is for general interest only and does not constitute specific advice. We do not accept any liability if you suffer any loss as a result of using our online service or relying on any information provided on it.

2. This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not systematically extract and/or re-utilise parts of the contents of the Site without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Site without our express written consent.

3. By displaying user-given content on this Site you expressly assign all copyright and other rights to such content to us (and you agree to waive all moral rights in relation to such content) for the avoidance of doubt we are permitted to use any user-generated content for any of our other business purposes, even following termination of your registration.

6. Listing a parking space

These terms will apply to anyone who advertises a parking space on our Site using our online service.

6.1 Listing a parking space

When adding your parking space you authorise us, on your behalf, to:

  • Advertise your Parking Space (and charging point, if applicable) on our Site and selected third party websites to increase the reach of your Parking Space to potential Drivers.
  • Provide information to Drivers and prospective Drivers who may wish to use the Parking Space and/or charging point.
  • Collect, accept and hold payments for your parking space, from the Drivers
  • Transfer the payments received from Drivers to you after deducting our uplift added on top of the set price.
  • Process all transactions using your account and the payment details that you provide to us, without the requirement to check that you have authorised such transactions.
  • Refer to you or your parking space at any time to promote our company.
  • Send promotional material out to Drivers who might want to use your space, and provide information about your parking space when needed.
  • Issue you with invoices and receipts in electronic format by email or other method.
  • Cancel any upcoming booking at our discretion.

6.2 Your responsibility for adding your parking space

If you use our online service to add your parking space, you are solely responsible for the accuracy of all the details and information on your listing. You must also ensure before any Booking Period that the parking space is in a satisfactory order and is able to meet the requirements of the Driver that has booked your space. We may remove your listing and/or cancel your listing if the parking space does not conform to the information you have provided

6.3 Hiding your space listing

If you wish to hide your space listing from our platform, you can do so at any time through your online account, this will not affect any bookings that has already been confirmed.

6.4 Cancelling a booking

If you need to cancel a booking we have accepted on your behalf, you should email us on bookings@place2park.co.uk.

6.5 If a Parking Enforcement event happens at the listed space

If a clamp is applied at the Space Owner’s parking space whereby the Driver is found by us to not be at fault, we will provide the Space Owner with 10 days to resolve the issue. A resolution will only be accepted whereby the clamp is shown as either cancelled or paid and therefore no longer an issue.

1. We reserve the right to charge the Space Owner for all additional fees and expenses we may incur (including legal fees and costs) in attempting to collect fees through commencing collection efforts, using the services of an external debt collection agency or issuing legal proceedings.

2. Where the clamp penalty fee remains outstanding after this time we will deduct the amount currently due from the Space Owner’s earnings.

6.6 Space Owner's responsibility for tax

You agree you are responsible for paying all fees and applicable taxes, in respect of any payments you receive from Drivers.

6.7 Insurance

If you use our online service to add your parking space, you will be entirely responsible for any and all insurance that you may require for the purposes of renting out your space and/or the charging point.

6.8 Space Owner restriction

If you are a Space Owner you agree:

  • You appoint us as your agent for the purposes of advertising the availability of your parking space; you also appoint us to collect your fees in relation to the Booking from the Driver.
  • You must provide us with any other information relating to you or the Parking Space as we may reasonably request at any time.
  • You agree that, if you allow any person who has: booked your parking space or made an enquiry about your parking space through our online service to park at your parking space, or allow anyone else who is responsible for or entitled to drive the same car as any such person to do so, at any time within six months of the end of the relevant booking period, or within six months of the most recent enquiry or of the time when the person became aware of the parking space through our online service, then we may charge that person the fees that would have been due under this agreement as though he or she had parked at your parking space in accordance with this agreement, and we may apply that person's deposit to the satisfaction of the amounts owed.
  • You agree you may not incorporate any additional terms into the agreement between you and the Driver other than the restrictions clearly included in your listing on our Site.

7. Payments

7.1 Our charge for the Online Service

Our charge for the online service available is an amount which we charge to the Driver paying for parking. This amount is added on to the amount which the Space Owner has set for the price of parking and is included in the total price paid by the Driver.

7.2 How is the price of parking calculated

The price to park at any parking space on our Site is set by the Space Owner, and the Space Owner will be free to change the price at any time. Price changes will not impact any previously confirmed bookings, unless the Space Owner wishes to issue a price increase on a current booking. The price advertised on our Site includes our fee that that we charge on top of the Space Owner's set price for providing the Online Service.

8. Our liability to you

1. If you choose to use the Website and online services, you do so at your sole risk. You acknowledge and agree that we do not have an obligation to conduct background checks on any Drivers or Space Owners. The Website and online service are provided "as is".

2. We do not own or operate the parking spaces available through the Online Service, and we are not responsible for any personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Online Service, or any booking with a Space Owner to the fullest extent permissible by law.

3. If you are using the Online Service as a Space Owner: we are not responsible for any personal injury or property damage, of any nature whatsoever, which you suffer in connection with your access to and use of the Online Service, or any booking with a Driver, to the fullest extent permissible by law. We are not responsible for any losses you suffer in connection with any claim brought against you by a Driver, or arising out of any interaction you have with a Driver in connection with us.

4. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any business loss.

5. We will not be liable for any virus or Trojan horses transmitted through our Site or emails. It is your responsibility to use suitable anti-virus software when using our Site.

6. You are solely responsible for all of your communications and interactions with other users of the Website or online service and with other persons with whom you communicate or interact as a result of your use of the Website or online service.

9. Changes to these terms

We may make changes to these terms, the format of the Site or online service provided, at any time without notice.

10. Termination and suspension

1. If you do not comply with the terms of this Agreement we may suspend or close your Account and you will not be able to use our online service (including taking, making and accepting Bookings).

2. If we withdraw the Online Service, and / or close your account, these arrangements will be brought to end, but the terms of the agreement between you and us, and the terms of any Parking Contract, will continue in full force, for any existing bookings or the consequences of any existing booking (including terms relating to payments, refunds, disclaimers, liability and damage).

3. If you close your account at any time, these arrangements will be brought to end, but the terms of the agreement between you and us, and the terms of any Parking Contract with Drivers will continue in full force, so far as they relate to existing bookings.

11. Confidentiality

Except as otherwise agreed in these terms, each party agrees with the other to keep secret and not share (except for with its employees, advisers and contractors) any confidential information it receives from the other party through our online service.

12. How we use your personal information

12.1 Privacy Policy

13. General

13.1 If a court finds part of these terms illegal, the rest will still continue in force

Each of the paragraphs of these terms operates separately and you agree that these terms are fair and reasonable in all circumstances. However if any part of these terms is disallowed or found to be ineffective by a court or relevant authority the other provisions shall continue to apply.

13.2 We may transfer this agreement to someone else

You acknowledge that we may transfer our rights under the terms (and any related claims) to any third party without having to obtain your prior permission provided that this will not affect your rights under the contract and that we notify you of the date on which we will transfer our rights and obligations to another legal entity.

13.3 If we delay in enforcing these terms

If we delay taking steps against you in respect of your breaking any of these terms, it will not prevent us taking steps against you in the future.

14. Governing Law and Jurisdiction

14.1 Governing Law

These terms and conditions and your use of this Website are governed exclusively by English law. We both agree to submit to the non-exclusive jurisdiction of the English courts, which means if you live in any other jurisdiction which gives you mandatory consumer protection rights, you may enforce your rights in connection with the terms, in accordance with such rights.
